As of July 14, 2018, it is still working its way through the slow legal system, with government lawyers dragging things out as long as possible. We will update when possible. Interesting, as everyone else including our lawyers can read them... The SHARK team appreciates those commenters who have a grasp of the US Constitution, and the vital rights it bestows on our citizens. Brave Americans have died to preserve and defend these rights, and it is tragic that so many people are not only unaware of their rights, but moreover are willing to give them up, and even insist that others do the same. The Constitution gives Americans the opportunity to stand, but standing requires a spine - something quite a number of people lack today. We will continue to stand strong with other proud Americans. November 13, 2016, a SHARK team uses an Angel drone to get an aerial view of Marshall Farms, a company in North Rose, New York that raises beagles, ferrets and other animals for research. Although absolutely no laws were broken, police made an illegal traffic stop that lasted more than an hour. The bullying and incompetence is hard to believe. Per the ACLU: Police may stop and briefly detain you only if there is reasonable suspicion that you committed, are committing or are about to commit a crime. The police lost their credibility, their dignity, and any legitimacy by selling out to a company that sells animals for research. Shame on the New York State Police and the Wayne County Sheriff's Department. We are in the process of reviewing our legal options, and will provide updates as decisions are made. Ya know , a lot of Americans don't realize that we have a very old law that is still on the books . The law states that Citizens may use force to prevent an unlawful arrest to the point of taking an arresting officer's life if necessary. Ckeck out Plummer vs State 136 Ind 306. His murder conviction was over turned by the Supreme Court of the United States on the basis of this law. The law further states that an arrest made with a defective warrant , or one issued without affidavit , or one that fails to allege that an actual crime has been committed by the one who is being arrested , the individual may resist arrest , break away and take the officers life to protect themselves against unlawful arrest. lf the arresting officer is killed by one who is so resisting the killing will be no more than an involuntary manslaughter charge at worst. I think the better thing to say would be in the lines of, "depending on what your end goal was for flying the drones over that community could we determine if what you were doing". Also if that person had a reasonable expectation of privacy then flying the drones over them would be violating their fourth amendment rights.

Ok I am for law and order... with that being said, I do not believe these guys to be what someone iz callin sovereign citizens. Reason being iz cause they were doing an investigation of the dog treatment and tryin to keep this on the DL (down low-secret). For those who don't understand what I am saying, when you get pulled over/harassed for nothing, get on your phone, call in a ''shots fired'' anonymous tip/call about ''shots fired'' at a nearby landmark close enough to the place to where the cop who pulled you over will have to split and say ''sorry I have an urgent call'', ''your lucky you are getting off with a warning!'' And then the officer will bolt to the location whihc had recieved the ''anonymous tip''. "they have a right to detain you until you provide identification." Absolutely, if they suspect them of a crime. They didn't. "who will get nowhere with this lawsuit...." They have a pretty open and shut case. The officers admitted to not suspecting them of a crime, which makes the entire stop unlawful. "to do nothing but piss those off who work to protest your area and waste their time." If the officers followed the law, then no time would have been wasted. That's their own fault.

Whether I agree with your cause or not, this is ridiculous. Flying a drone over private property is not illegal and the state cannot even regulate the flying of drones over private property because it is out of their jurisdiction. Look at Singer v. City of Newton. That case only applies to the federal district court of Massachusetts, but it would be a decent case to reference. There are several issues of unlawful detainment because of the lack of RAS and the duration of the stop plus the failure to ID is an issue. They were able to ID the driver on (iffy) grounds of a traffic stop, but passengers cannot be required to identify as part of a traffic stop. Requiring them to do so as part of a traffic stop would be an illegal. I specify traffic stop because requiring ID as an investigation regarding illegal activity for the drone (stalking or harassment, not trespassing) would be allowed, but the officer already said they were doing anything illegal and the people just wanted to know who you were. Again, regardless of whether I agree with your cause, go get 'em.

I don't necessarily disagree with you regarding the actions of SHARK BUT the behavior of the officers is still unacceptable. I do drone work and I know that simply flying over private property is not illegal nor are they or the state allowed to regulate where an aircraft can fly. Then there are the multiple constitutional violations that I saw. The officers admitted there was no crime- the complainant just wanted to know who they were. There wasn't a legitimate traffic stop, there wasn't a legitimate detainment, and there wasn't a legitimate search and seizure. That's a problem whether it is SHARK or not.

the morel of the story is to Uber to and from your 'illegal' drone flying. Also, get a lawyer beforehand so you know the law and articulate it clearly with legal code references so you can avoid this in the future. Also, avoid proximity to the drone, many of them have a decent range and you should have been able to buzz their property parameter from a distance too great to detect but still be within line of sight which is required by the FAA. Also, it is NOT illegal to fly over private property that isn't restricted airspace. FAA owns this airspace in the US and while some people find this practice and/or lack of clarity highly annoying, it's not illegal. See: https://www.faa.gov/uas/faqs/#ffr ( Disclaimer: This is not legal advice, please seek professional legal counsel, no really, don't just do something because some guy on the internet said it was ok) Also, just give the police your license, I'm surprised this state trooper didn't just follow you long enough to find something you did that gave him probable cause to pull you over, honestly, it doesn't take much. And, if you know the FAA laws and the fact that NY basically has no local laws on this topic, you'd be on your way (probably after an hour of idling.) Also, to get out of the idling around for an hour, just complain of chest pain and ask them for medical assistance. ;) (hate the game, not the players)

Technically, it's public airspace and anything that can be seen from public can photographed and video recorded. In New York, where this incident seems to have occurred, the NY Supreme Court ruled that even taking photos of someone through their windows was constitutionally protected. The case is Foster, et al. v Svenson. As for intellectual information, they'd have to sue and prove that was what they were doing. That's not a criminal matter.

SHARK: Not an illegal stop. They were responding to a complaint involving that vehicle and driver. They have the right and actually responsibility to investigate. People believe that they have the right to refuse compliance with law enforcement. Typically people who refuse to comply know they’ve done something either illegal or immoral. Let the police do their job. They weren’t abusive, aggressive or even rude. It’s the most patient stop I’ve ever seen.

I don't agree how you guys do things, and the police aren't in anyone's pockets, but if you can't fly a drone over private property, you can't fly it over your neighbors house. Amazon's in trouble. They want to deliver packages by drone so they'll be flying over several private properties! Call in to that police dept and tell them you want to file a complaint about being held hostage by 5-6 Leo for over an hour on the side of the road, then bound and taken somewhere against your will and held for several hours. You think you can identity some of the people. Then give the names of the officers who held you because someone didn't like you using the airspace. I don't believe they can own that. Therefore, it's not private property.

1 - why doesn't matter in the eyes of the police because it is not illegal to do so, and therefore it is none of the police's business. Your question needs to be 'why are the police getting involved in non-illegal activity' . If you personally want to know why, the video makes it clear that the flyers are investigating animal cruelty. You may disagree with their motives but under the law as it exists in NY state right now, they did nothing illegal 2 - they were stopped illegally by the police. When the police realized that they made a mistake, they should have moved on. Hopefully, they were counter-sued for trespass if they weren't charged with the crime of trespassing. How would you like it if they flew their drone over your property and pointed its 1080p HD camera into the window of your daughter's bedroom? I get it you feel a personal commitment to stop animal cruelty but how do you know for sure it’s going on. The federal and state government has obviously sanctioned their practice so it’s legal. I get police brutality, but this is just citizens being hard headed, they were stopped for suspicion due to a complaint of a drone, (possible invasion of privacy) and refused to identify themselves. These cops were being very professional about it. They did not act very disrespectful at all, even though they were being disrespected.
