As of July 14, 2018, it is still working its way through the slow legal system, with government lawyers dragging things out as long as possible. We will update when possible. Interesting, as everyone else including our lawyers can read them... The SHARK team appreciates those commenters who have a grasp of the US Constitution, and the vital rights it bestows on our citizens. Brave Americans have died to preserve and defend these rights, and it is tragic that so many people are not only unaware of their rights, but moreover are willing to give them up, and even insist that others do the same. The Constitution gives Americans the opportunity to stand, but standing requires a spine - something quite a number of people lack today. We will continue to stand strong with other proud Americans. November 13, 2016, a SHARK team uses an Angel drone to get an aerial view of Marshall Farms, a company in North Rose, New York that raises beagles, ferrets and other animals for research. Although absolutely no laws were broken, police made an illegal traffic stop that lasted more than an hour. The bullying and incompetence is hard to believe. Per the ACLU: Police may stop and briefly detain you only if there is reasonable suspicion that you committed, are committing or are about to commit a crime. The police lost their credibility, their dignity, and any legitimacy by selling out to a company that sells animals for research. Shame on the New York State Police and the Wayne County Sheriff's Department. We are in the process of reviewing our legal options, and will provide updates as decisions are made. Nobody mentioned video recording during any of this. Also, that law specifies residential property. They were flying over commercial property. From your link: S870A (ACTIVE) - SUMMARY Establishes a private right of action for owners and tenants of residential premises against persons video taping recreational activities in the backyard of such premises. The person complaining was a commercial operation as mentioned in the first thirty seconds of the video by the officers. They were not taping recreation activities in the backyard of such premises. Nice try, come back when you know what you're talking about.

If you think you are being mistreated, continue to record the encounter, remain polite, then go to a civil rights attorney and see if you have grounds for a law suit.  Being jerks and extending the encounter by refusing to show an ID doesn't help you when its time to file the law suit.  If the guy had shown his ID this would have ended quickly.  BTW,  I appreciate the libertarian ideology of these guys, but you infringed on another citizen's right to privacy by flying a drone over their business and conducting surveillance.  If you do that (for any reason) then you should be expecting to have an encounter with the police, just as you would want if you looked up and saw a drone watching you on your property.

Don Steinbarge: The issue is that the police had no legitimate reason for the stop, and they admit that. They stopped the vehicle to get information for a private party, and they admit that. I can't have the police pull you over simply because I want your personal information. That is obvious, right? But that is what happened. It is legal to fly over private property, and it is done all the time - millions of times every day. Nevertheless, these police pulled a car over and demanded the information of the driver without any legitimate cause, and then went so far as to arrest the passengers for not identifying themselves. When six police officers go that far out of bounds, that is the definition of corruption. Between them they had many decades of experience, so they knew what they were doing, and they knew that what they were doing was wrong.

Good god. Do people even listen or watch the video? They weren't flying over someone's home, they were flying over an commercial operation that has a reputation for animal cruelty. It's far easier to make a knee-jerk reaction and cry foul than to actually educate yourself on the law or the situation, apparently. I weep for our nation when our citizens worship authority to the point where they refuse to hear the facts. THIS is why we have a second amendment people. It's not the drone guys following the FAA rules here we should be worried about. It's the cops ignoring them. I can hear it now, people saying that attitude is anti cop... it's anti stupid cop. We have a right to expect them to know the laws they are trying to enforce. I firmly believe 80% of the officers on duty are good people here to do their best to serve. Every time I have an encounter with police officers I say "hello office how are You? Here is my ID, insurance and registration" with a smile. 99.9% of the time I get a warning for what I may have done. I do not argue With them and refuse to show ID just to get harassed. Probable Cause is a real thing. If you act suspicious they can stop you and start asking questions to make sure you aren't scoping the place out to rob it or something. They need to know who the neighborhood creep is! Which in this case it's you! When you go around spying on people with flying cameras that's called being a creep! People like that often end up following it up with burglary, assault, murder, rape... any number of malicious things, so yeah, you are a being a creep and they had questions! How would you feel if someone had drone looking in through the windows of YOUR home? Would that make you feel awkward? That's the same thing you just did. The cops had probable cause to check you out and in such a case they do indeed have the right to id you. They need to know if the next Ted Bundy is lurking around.

Under the US Constitution the police can detain you for questioning if they have a reasonable suspicion you committed a crime. They can arrest you if they have probable cause you committed a crime. In neither case does your identity matter. Some states have laws that require some form of identity confirmation. Better know the local laws before refusing. Remember: even if they are wrong they are the ones with guns and billy clubs.

I agree with the owners of the property and the police department, because there are a lot of radical people in this country that are illegal aren't supposed to be here and are doing really bad things out there... In what state is that a law? The FAA regulates airspace and nowhere in america is it illegal to operate an aircraft over private property. How could any airline stay in business otherwise? Sure, there are no fly areas, but they are a military or of some national importance. Please call your local FAA office and check if you don't believe me. You do not own the airspace over your property. Period. It's a national resource.

I don't know much about the law , I believe you don't have to prove your identity to a police officer . However when you're behind the wheel of a motor vehicle you are then required to provide identification for purpose of confirmation that you're a licensed driver. My suggestion to you the next time you'd like to remain anonymous would be to bicycle your way to and from the area you wish to fly your drone, then and only then you will not have to show your identification. Unfortunately all you've managed to accomplish is to tie up first responders when other people may have legitimately needed them... so please think of that the next time you want to make a point.

Have these cops ever heard of the phrase "Fruits of the Poisonous Tree"? They didn't know the law (apparently, if you take at face value what the producers of this video state about flying drones over private property in NYS not being illegal), and therefore did not have reasonable suspicion to stop and detain these persons. Now, they want to initiate a custodial arrest for not providing ID after an illegal detention. Keystone Cop give the rest of us a bad name.

Do you not feel at all hypocritical that you're complaining that you were harassed whilst going about your lawful business - which in this case was harassing other people going about their lawful business? You might not like what their business does, but it is legal. Or were you searching for evidence of illegality? In which case you'd be very much like the cops you have so much disdain for. Incidentally, whilst the police obviously need more knowledge of the law than the average citizen, it's not their role to be legal experts - even if the law was clear cut, which it often isn't. Would you object to the police questioning people conducting surveillance of a bank, a military base or a school? The law has not yet caught up with drones, but it's hardly unreasonable for individuals or businesses to object to being filmed on their own property. I doubt you'd be too happy if I loaded a helicopter up with a film crew and hovered low over your garden, but that's just as legal as what you were doing.

Forgive me for my somewhat lack of clarity here; But if you fly something over private property WITHOUT the consent of the owner, is this not tantamount to stealing?? I would be angry if someone flew a drone over my house, in fact I would endeavour to shoot it down. It's a breach of personal space is it not? Like me walking into your living room unannounced, I don't think you would be very happy? Having said that, calling the cops is a tad OTT in my humble opinion, maybe a warning or something to that effect.

No. It isn't. it is not illegal to operate an aircraft (and yes, as long as I have to register my drone with the FAA, it's an aircraft) over private property. If it was, how could any airline continue to operate? Are you going to complain about every airplane in the sky? US Airspace is a public resource. Don't take my word for it. PLEASE call your local FAA and ask. Quit harassing people that are operating perfectly legally. If you don't like the law, take it up with your elected representatives. But don't expect the cops to come hassle someone who is not breaking any law. Before you write me off, *I* passed the FAA test to get my license to fly both drones and fixed wing aircraft. Did you?

it is not illegal to operate an aircraft (and yes, as long as I have to register my drone with the FAA, it's an aircraft) over private property. If it was, how could any airline continue to operate? Are you going to complain about every airplane in the sky? US Airspace is a public resource. Don't take my word for it. PLEASE call your local FAA and ask. Quit harassing people that are operating perfectly legally. If you don't like the law, take it up with your elected representatives.

Flying over something is not trespassing. Learn the federal law. You do NOT own the airspace over your property. It is a shared resource for commerce regulated for the FAA. As long as I am abiding by FAA regulations, flying a registered aircraft (either remotely piloted or not), there's not issue flying over private property. IF this was the case, how could any airline stay in business? Just because you are ignorant, doesn't make something illegal. Seriously, call your FAA local office and ask. They are in the phone book. Until then, you're just showing how little you know about the world around you.

I respectively disagree with the posting of this video. It's a unfortunate you and your videographer feel the need to test how NY State Troopers would respond to a complaint about an unknown person or company flying a drone over someone else's property. It is a waste of NY state taxpayers (me) and valuable resources for the Troopers because you felt the need to check what legality they had for stopping you. In today's age of terrorism and gun violence, how about one day you suit up and go on a ride along with these very same troopers to see how they put their lives on the line for us daily, and wonder if today is the day I might not be able to come home and see their family. They never know what to expect during a "stop" and your disrespect towards them during your pullover testing their authority is the very reason why police officers are fearful for their lives each day. Perhaps you can use your drone for other positive reasons, like reporting suspicious activity rather than creating it ???? I'm a law abiding NY citizen who was really upset after seeing this video. I will expect some return comment to justify what you did, and that is ok, but I am hopeful the officers who see this post can hear me say the words :  Thank you so much for coming to work each day and do what you were trained to do which is to help keep us safe. We live in an dangerous world now more than ever and I know it is hard enough to manage daily occurrences w/o people like this adding to it and who are not thankful for your services. Please do not let people like this deter you from being objective in the future. There are many citizens, including myself who are very thankful and if/when I get pulled over my answers to any officers questions is yes sir/ma'am/officer.
